Providing Electronic Proof of Insurance is not Consenting to Search

Texans can now provide proof of their insurance to an officer on their smart phone. The Texas Legislature passed Senate Bill 181, which is now enacted in Transportation Code Section 601.151. It allows proof of insurance to be supplied to an officer by displaying it on a wireless communication device.

The same code also provides that providing proof of insurance to an officer, or anyone else, by displaying it on your wireless communication device does not give the person permission to access anything else on your phone.

The Property Casualty Insurers Association of America reports that Texas was one of twenty states across the country that was considering allowing electronic proof of insurance.
